Toots, you clearly have no idea of how victory or defeat is decided in a court of Law. To the victor the spoils, £7500 the interim interdict lifted and our pursuers forced to abandon the case.

You would have pi**ed your pants, had you been in our position. And your lack of reality would have buried you right at the outset.

You were just very lucky.. that the new management/ directors decided that suing two people who did not have a pot to pi** in was not in the interests of their company.... even a one-eyed dog with no legs would have been awarded costs...... but it would not make out it had won the case....IMO...

I would love to read your version of it.... But the reality is.... the other side abandoned the case..... and I am not in the slightest bit worried about Toots... she has made a fool of you so many times in the past... and as for the Middle Post... you will forgive me if I decline your offer.... :lol:

From the way I read it it was more choice than force that led to the abandoment of the case and a sensible choice at that. Having an interim interdict lifted isn't anything to be proud of.

I'm not the first person you've said that too am I? I wouldn't have pi**ed my pants I spent 7 years in and out of court. Ok I never spent time there regarding a libel case but I'm more than use to courts

There was no choice of abandonment here. Eminent QC Kinroy had been manoevred by us into a position of certain defeat.

Let me say first though that the claims we made would have been substantiated in any trial. Colky proved he was the scumbag we said he was when he jumped ship and took CRT's company data with him.

As for the case, Lord Emslie accepted that the system is based on a commercial basis, and that we were entitled to proper represntation to protect our rights. He would have allowed us as long as it took to get that representation.

Remember, when we went into court it was costing us £45. CRT's representation was running at around £5000.

There was no choice here. We knew how the system worked and knew how to use it to defeat CRT. CRT were not prepared to shell out for a defence which had nothing to do with the company. It was Colky who was attacked. It was Colky who persuaded the company to shell out to defend him. Quite enterprising for someone who wasn't even qualified to be on the committee in the first place, far less its Chairman.

Interesting that the committee who supported him is substantially still in place. Draw your own conclusions.

CRT, through Kinroy, thought all they had to do was bring in the big legal guns to intimidate two scrotes. It was a slam dunk. Interim interdict, two scrotes silenced, the scumbags on the committee reelected.

But the two scrotes didn't play ball. They recognised the system and used it to defeat CRT. CRT was stiffed, shelling out up to a hundred grand for the privilege. To my knowledge they haven't divulged how much it cost, even to the members. That's some democracy, eh? And the scumbags responsible are still in place. Members get what they deserve.

CRT had NO choice Toots. They were stiffed.

Too right. We wanted the case to run forever. We knew the MacDonald case cost £11 million. We had the chance to put CRT out of business. And it would have if they hadn't puylled the case.

So, if there was a choice, it was to acknowledge defeat and stay in business, or fail to acknowledge defeat and lose the company.

I'd be interested to know whether CRT binned its lawyers for poor advice, or whether the lawyers binned CRT for being a bad client?

Ask your source toots and let us all know.
