Exactly.

The condition is on a PH Operator Licence irrespective of whether or not the operator has Hackneys on the system or not.

This is a Magistrates' Court decision & is not binding, as it is not case law.

I believe case law starts at Crown Court or any higher court, but I may be wrong.

The York Magistrates obviously thought that the condition was not reasonable, but that does not mean that other courts would not see it differently.
