Im Curious.......Can Hotels or B&Bs etc offer Complimentary transport using their own vehicle without having it Licenced by a local authority.

Im kind of half a Mind that For "Hire or Reward" means that if they benefit either directly or indirectly that it is still deemed to be reward.

Any thoughts.

There was a post on here relating to something like this between a pub and a restaurant but I can't find it. Perhaps somebody else will :D

Maybe if it's free.

Wimbledon Tennis use complimentary cars for the staff and players, and they're not PCO licensed.

But they are not offering a service with a view to gain a profit out of those free cars.

Whereas in the B&B scenario the 'free' service is part of the paid service.

They can in Scotland unfortunately. :sad:
The 1982 act still contains the 24hr contract exemption. I believe the similar 7 day exemption in England was abolished a couple of years ago.

The people offering this Complimentary Pick up service would not come under the 24 Hour rule as that exemption permits only one Mutually agreed Contract in any given 24 hour period....if they Picked up say 3 different clients at a railway station then that would be more than permitted under the 24 Exemption..

It's only one contract if it is all for the same place e.g. bloodnock's B&B or Happy Harry's Hotel. That's how all the hotels up here get away with running courtesy buses without a licence.
As it's still hire & reward, they should still have insurance that covers this.

It's about time this 24 hr rule was ditched IMO. It's been abused for years.

It cant possibly be classed as One agree Contract..it might be to only One Venue but it is likely to Involve several Individuals..therefore it would require several independantly agreed contracts and under an Exemption which only allows for only one agreed Contract in a 24 hours period.

Ive no Truck with the 24 hour Exemption Concept..but if its being abused then its wrong.

They don't have to use to a third party, although the transport can be a separate business.
The venue is a business, e.g. a LTD company, a separate legal entity from it's owner and the transport may be yet another legal entity.
Venue has an exclusive contract with the transport. Transport bills the venue and the venue recoups it's costs from it's profits. It claims it against tax, like you would a garage bill.
