Due to the planned Teachers' strike on Thursday 30th June 2011, I am writing to make you aware that some schools may choose to close.



As a result, operators are requested to check with each individual school that they serve as soon as possible to confirm if the school will be open or not on this date. For operators who have contracts that serve more than one school it will be important for them to check with each school that they serve.



This email serves as more than 5 working days notice, therefore in accordance with section 8(d) of the large vehicle contract conditions schedule 2B and section 23 of the small vehicle contract conditions Schedule 2 (Section B), no payment will be made for any contracted journey(s) that are cancelled as a result of the strike action at schools that you serve on Thursday 30th June 2011. Please adjust your invoice(s) accordingly.

Unless the Local authority can say with a 100% certainty which schools are to be closed on the date mentioned then they will have failed to give adequate notification and the operators will have the right to charge for those days...its up to the LA to find these things out, not the operators..

Well if the operator doesn't check and the school is closed, payment for the whole month will be withheld. I guarantee that if a claim is made for a school that is closed the operator will be contacted by the council after a minimum of 21 days to say that there is an error and a new invoice will need to be submitted. The 30 days payment period will then start again.

i did like the phone call i had cos they hadnt had my april invoice, i said the school was shut all of april but i could invoice them for something if they really wanted

Send two invoices then.

One for the month, less the disputed day and one for the disputed day. Then they can't hold up the main invoice.

No, they would hold them both up because you were claiming twice for the same work and again they would not say anything until at least 21 days had passed etc.

chicken/egg int it, how do they know what schools will be closed when even the schools dont know?
