I know when I had my insurance problem it was only because I was prepared to represent myself in court, that the other side backed down and accepted full responsibility for the accident.
Despite being 100% in the right, my insurance company would not fight the case on my behalf, and that's when I found out about the memorandum of understanding between insurance companies.
They do their level best not to go down the legal route. They simply cover their own costs/damages and rack up insurance premiums, against both parties, if no one is prepared to accept full responsibility for the accident.
I know things have changed, since Direct Line Insurance bucked the trend but for the most part, they all avoid going into court to get a settlement. It makes much more sense just to right off their losses, rather than going down the legal route, at a huge expense for everyone involved.
The story of two insurance companies slugging it out in court on behalf of the wee man, is a myth.
In other words, they are a bunch of crooks.
