Taxi driver accused of raping drunk passenger walks free from court


A TAXI driver accused of raping a drunk female passenger has walked free from court in Aberdeen.


Richard Donnelly, 51 had been on trial at the High Court in Aberdeen accused of raping the woman while she was incapable of giving or withholding consent while under the influence of alcohol.

Donnelly, whose address was given in court papers as 22 Hospitalfield Gardens, Arbroath, denied raping the woman in his taxi in a wooded area near Charleton Road, Montrose, on November 3, 2012.

Donnelly wept in the dock as the jury returned a majority verdict of not proven.

Lady Scott, who oversaw the trial told Donnelly was free to go before dismissing the jury.
