Taxi Driver Online

What cab should a punter go to on a rank, and are there any laws regarding this, I am asking this as I think we have the only rank in the world where the punter can pick and chose
Please post any links as we are trying to get this sorted, the rank holds 9 cabs and there is a barrier from cab 4 to 2 then a gap for cab1 to get the doors open then the barrier continues,

There is also no signage telling the punters where to go or stand only taxi painted on the edge of the rank on the road

Members of the public can choose any cab they wish and it is an offence in England and Wales for a cab driver to refuse to take a passenger without reasonable cause. The exception being out of area jobs.

Established etiquette in most areas is to send the passenger to the front of the rank. Many years ago I was told Sheffield practised a similar system to the one you describe. Whether or not that is true I don't know.

City of Lincoln byelaws: 7.(e) "If his carriage is stationed on a stand, not accept an offer from a member of the public to hire his carriage unless his carriage is stationed in the foremost position on that stand"
Saves a lot of aggro.

However, in Sleaford, (North Kesteven DC) it's an "any car" rule.

I prefer front car only, it's fair to passengers in that they, as well as the driver can "reasonably refuse" though.

That bylaw wouldn't stand up in a court of law. I advise you to tell Kevin Barron to read court cases on this website.

Town police clauses act 1847 Section 53 Penalty on driver for refusing to drive.

A driver of a hackney carriage standing at any of the stands for hackney carriages appointed by the commissioners, or in any street, who refuses or neglects, without reasonable excuse, to drive such carriage to any place within the prescribed distance, or the distance to be appointed by any byelaw of the commissioners, not exceeding the prescribed distance, to which he is directed to drive by the person hiring or wishing to hire such carriage, shall for every such offence be liable to a penalty not exceeding [level 2 on the standard scale].

Amendment

Maximum penalty increased and converted to a level on the standard scale by the Criminal Justice Act 1982, ss 37, 39,46, Sch 3. Modification
Modified, in relation to the taxi code, by the Licensed Taxis (Hiring at Separate Fares) Order 1986, SI 1986/1386, art 4.

I would not dream of telling Kevin Barron anything. (close, but no cigar, by the way) Who though would challange such a bylaw? You? Why?

No chance. The times I have tried to get passengers to make a legitimate complaint against drivers. (overcharging, improper behaviour, refusal to carry, etc. etc.) they never do, and I do not see why in this case, that they ever would. Unless you can produce case law to prove otherwise.

The way some taxi drivers try to queue jump the ranks is making me think twice about joining your side of the trade.

Perhaps it needs a bit of good old PH honesty to sort it all out.
