My CRB is due for renewal on 31/12/06 as is my licence, The LO made todays appointment and i attended on time.
He stated that if it's not been returned by the due date he wont issue my licence, so in effect i'll be suspended from driving until it appears.
Have i read somewhere on TDO of a legal challenge that was upheld in favour of a driver who's CRB didnt arrive on time through no fault of his own?
The LO make the appointment and the form is completed in front of him and they post it off.

My license and CRO checks were sent to the PCO after they fell through the letterbox today, and the butler brought them to me.

My licence expires on the 12th of next month, they then go on to tell you the CRO checks are taking about 6 weeks! :D

Will I stop working if its not back by the 12th of October?

I think most councils allow existing license holders to carry on working while the CRB is going through, providing they apply before their old license runs out.

I think they could be in trouble if they didn't i.e. how could they prove you weren't 'fit and proper' without the CRB check? :?

I heard of something similar down south, the driver wasn't licensed until the CRB was returned, which wasnt until about three weeks after the license expired.

I suppose the argument from the LA is that the fitness and propriety is judged upon your CRB,

However, wouldnt a valid argument be that the LA have fettered their discretion to an outside agency?

my own personal approach would be to ask your licensing officer for a temporary licence (one month) and if he refused, before my existence licence expired I would appeal through the courts, until the appeal is heard you're still licensed, if in the meantime your CRB check had returned then everything is OK, cancel the appeal..... Sefton will give a temporary continuation of licence..... after all is not your fault they are rubbish....

Yes, I've dusted of the old tandem, and plan to start a 'd.i.y rickshaw' service from next weekend. I'll steer, they pedal. :wink:

What the PCO does for PH Drivers in London, if the CRB does not come through in time is issue a tempory permit to cover the driver until it does.

May be other area's in country should do the same??

Yes we get a 'cover note' to show to the Police / Carriage officers until the CRB check returns, but only if your renewing your existing license. :wink:

If you have already had a CRC why the hell should you have another one, If you are still doing the same job??? you just need a police check. there are loads of jobs where the CRC is done but they don't need to do it again until they start a new job, Its just another government scam :x :x :x

because a license is like a dog it's not just for xmas it's for life. Circumstances change and it is only fair that the general public should be protected from those who get their license, and for whatever reason break the law and therefore are no longer " fit & proper" and can no longer have a license and this is the only way of regulating this.

Quite agree with you pal however we live in the world not the perfect world and if a convicted driver choses not to declare a conviction to his LA then there is enevitably a period of time where he/she is driving illegally :shock:

That my friend is life, the main point here is they can not get away this forever surely :?:

But in the provinces a person wouldnt be granted a license until a CRB was produced.

My CRB (re) application form was sent off on 1st August, still has not come back, my badge was renewed anyway, of course. Wonder how many new applicants have given up and got a proper job?

A mate of mine filled in two CRBs within months of them starting about five years ago. The council said they lost the first.

Still to receive either of them. :shock:
