Can this be done
a driver lost his drive, had lots of private contracts etc etc, he wants to carry on, another driver was on the phone to him tonight [overheard], this is what was said, get another vehicle, use your own hire and reward insurance and stick a sticker on the vehicle using the words “Executive Travel”, it’s a loophole, true or false.

I suppose he might be trying to use the 7 day exemption, but if your local LO wants to get him, then it will be a piece of p**s to do so. :wink:

It can be done legally if he has cleverly worded contractual agreements with the customers he will supply exclusively.

But that is hard work.

So he can do it illegally, knowing that as long as he doesn't flaunt it under your nose too much and stays small and discreet he can get away with it for years.

And when a council officer eventually chases it up he can flog them off with some silly little story about 'only doing work for my mate 50 miles away under contract etc' and then the council officer will ignore it again.

I have letters dating over ten years dealing with one small company. The council took him to court on my evidence in 1997 and 2002 but he still keeps going.

I recently noticed an Insurance Company offering cover for "Contract only" work, I phoned and enquired as to what constitutes "contract" I was told contract between 1 person/customer for your vehicle for 7 days or more.
So, does this cover, say a vehicle breakdown company using an unlicensed car/chaufeur/executive company to cover say 50 pickups of various people constitute 1 person/customer(being the breakdown company) contract for 7 days or more?

I think thats the argument.

You could have 50 exclusive hires and the law isnt too clear, but get rid of section 75(1)(b) and hey presto you have to be licensed!

I'd not heard of the 7 day thing (someone elaborate?) or this 'executive travel' ''loophole'' but it seems a wast of time to do, as you still need hire/reward insurance, the only saving is crossing the local councils palm with its yearly pound of flesh.

Surely the extra work that could be done from being 'legit' more than compensates for the pound of flesh even taking into account the added expense of vehicle inspections and replacing things that are not needed just to please them/make them feel like they are actually doing a job?

And dont start me on the 'Limousine' trade.............


And I'd just like to point out that even with my username, I'm not the driver(s) mentioned above!

If you care to read most of the licencing threads on here and take a look at www.talkinglimos.co.uk you will see that the limo trade have had a major kick up the jacksie and as such most of the unlicenced trade is now void, and hopefully with the removal of section 75 this will become even more apparrent. I do appreciate where your coming from but believe me these issues are rapidly becoming history as you will see :wink:

What alteration?

Can anyone give me further details. as well as a hc I also have a merc which is only available on a day hire basis under section 75.

Please don't start me on the Limo V PH debate! As you know I run hackney / PH and limo and the seven day loop hole needs closing PDQ! Basically if your going to use the Limo 7 day contract then basically agreeing that your LIMO will only be available to that contract for 7days! I think not!

I did try to register my Limo as a PH and get the appropriate licence but its considered Hackney as it has a bulkhead etc and its 20 years old so can't be hackney - joyous oh joy we try to assist our clients! What a wonderous web we weave and dodge by whatever means we can!
