I had some punters who were from scotland,where the ban is already in force.
They said exactly the same thing about how the pubs and clubs smelt these days.

So they said that they tended to have get togethers in their homes instead.
I think this is going to be bad news for us lot..............

I have decided to appeal my fine. Letter of appeal is below and I'll let you know how I get on.

Regarding : Fixed Penalty Notice

Dear Sir / Madam

I am writing to dispute the validity of this Fixed Penalty Notice and request a hearing based on the following.

It is my belief that the person who gave me the Fixed Penalty notice did not adhere to the rules laid down by the Scottish Parliament for the enforcement of the Smoking, Health and Social Care (Scotland) Act 2005. In particular :

• The officer was not in uniform and did not show me any Identification
• The vehicle was not displaying environment department stickers
• I was not asked whether or not I had been smoking in the vehicle
• I was detained against my will whilst on my own time, ie not working
• I was not informed of my right to withhold my personal information
• The second person in the car did not at any time approach my car nor identify himself as a council representative

Additionally on the Fixed Penalty Notice the postcode on the form does not correspond to the postcode I gave the person issuing the fixed penalty notice.

Finally the non-smoking premises stated on the Fixed Penalty Notice alleges that I was smoking in a PH Taxi, which is presumed to mean Private Hire Taxi. As you will be aware there is no legal entity that is licensed for use in the carrying of members of the public described as a Private Hire taxi. Indeed Renfrewshire Councils literature,
Website, and licensing forms clearly distinguish that there are two forms of licensed vehicle, a Taxi or a Private Hire Car.

As my license is for a Private Hire Car and not a Taxi, I do not have the right to call myself or behave as a Taxi. Indeed, were I to do so, I would be subject to disciplinary procedures.

In brief I believe the Fixed Penalty notice to be in error as I have not been asked to admit or deny the alleged offence, the rules for giving out the Fixed Penalty have not been adhered to by Renfrewshire Council, the information regarding my address is inaccurate and most importantly the premises described on the Fixed Penalty Notice do not in fact exist as a legal entity.

I look forward to your response.

Not only have the Council got the cheek to issue Fixed Penalties without following the correct course of action, they want to charge extra if you phoine up to pay it.

Still no word on my appeal yet, but the woman receiving my letter of contest seemed genuinely flabbergasted that someone had the audacity to challenge the authority of the Cooncil. If I could have bottled that look it would have made me a fortune lol.

i am not sure but to comply with the smoking ban [vehicles] i seem to read on Local Goverment websites that the vehicle ash trays should be removed, but its not clear

lets look at this scene

your cab is smoke free, the driver don't smoke

you pick up a punter who sucks hard on his fag before getting in, exhales it into your face as they tell you where they are going, filling the cab and yourself full of smoke

can you then be found guilty of allowing smoking in your cab

just a thought

A group challenging the legality of the smoking ban has given the Government a ‘last chance’ to consider amendments or face them in the High Courts.

Lawyers acting on behalf of Freedom to Choose have written to Health Secretary Patricia Hewitt and the Attorney General giving them 14 days to respond to their concerns or they will request a judicial review of the ban.


The infringement of human rights is something everyone feels very strongly about and we are not going to go away.

Human rights lawyer Jaswinder Gill.

Jaswinder Gill, from law firm Ormerods, said the group’s challenge will be based on what it sees as infringements of human rights.

He said the ban, which will make it illegal for a licensee to smoke in his or her pub even when it is closed, will infringe their right to enjoy their own property and possessions and similarly a private hire vehicle driver’s rights to smoke in his car when off-duty or when no passengers are on board.

He told morningadvertiser.co.uk: “We have requested a response within 14 days.

“In the absence of an adequate response, we shall proceed with a full legal challenge in the High Court on grounds of fundamental infringement of these rights prior to 1st July 2007.”

Gill added: “The infringement of human rights is something everyone feels very strongly about and we are not going to go away.”

Freedom to Choose is a group made up of licensees and other interested parties and is funded by donations.
