Taylor’s case has been remitted back to the council. QC Armstrong conceded that Edinburgh Council had acted contrary to natural justice. The Sheriff was not prepared to give a deemed grant there and then as it is for the council to decide council policy and not the Sheriff.

Had the Sheriff granted the licence at this juncture the council would have appealed? And without sufficient grounds to support the Sheriffs decision it was likely to be overturned on appeal at a later date, sending it back before the council RC. Now it is up to the new RC to hear the presentation all over again and come to a decision.

My bet is if they intend to deny the licence all over again they will cave in at the eleventh hour before councillors are forced to take the stand. Just to buy time. However, it might be that they intend to grant the licence subject to pulling the plug on the whole trade.

I don’t think the council have any intentions of going into court.

Btw, there was a number of Edinburgh cabbies there watching proceedings. Now wait for it…. They started to cheer and clap when the Sheriff remitted the case back to the council. :oops: :oops: It was embarrassing. And it takes a lot to embarrass me. :oops: :oops: These a*holes think this game is like a football match. While talking to the solicitor afterwards we did our best to distance ourselves by saying, we didn’t know any of them. Honestly you had to be there, it was all too apparent they were all sharing the same brain sell. :oops: :oops: :oops:

I have no doubt this will be hailed as a victory and now I bet most of you will understand why.

Btw II, to all you big tough taxi drivers that I smiled at, winked and blew kisses too, I am very approachable. You know this, not one of them even uttered so much as a word.

John Galloway did make a funny face but then I wasn’t sure if he was putting on or not.

Surely the Sheriff wasn't decided council policy he was deciding on the law.

My guess is he is kopping out, but referring it back to the council will only delay the inevitable.

As for those that may cheer and laugh, I wonder how many of them were in the Ali T will never get his plate brigade. :wink:

Yes, but that’s why it had to be remitted back to the council. The council conceded the ground of natural justice. It was therefore incumbent upon the Sheriff to hand it back to the council for reconsideration. It’s a new RC committee in Edinburgh and not the nest of vipers that started all of this. The Sheriff made the point it would be a huge leap to presume they would be unreasonable at this stage.

Yes again, but even if we had grounds (and I believed we did) and the Sheriff had take the decision to deem grand the council would have appealed, and if we had lost at any stage it would be back in the hands of the RC. This way, if the RC refuses there is no turning back. All they can do is grant or face being called into the witness box. The three grounds of appeal remain. The council can’t introduce any more information to deny but the new committee must hear the case again, putting their heads on the chopping block.

Honestly Sussex, they are irrelevant, not only to the council but to the whole proceedings and the sad thing is, they don’t even know it.

The actually thought they’d come to cheer their side on, like they made a difference.

Why don't you explain what happened so we can all understand the victory your side achieved?

btw, there is no such a thing as a failed cabby it's only a job that monkeys don't want.

It looks like you have taken the wrong set of keys to court , keys are handy for opening doors that are being locked...but they have to be the right ones :wink:
