There is no burden of proof. You are in fact presumed guilty and you stay that way.
The vast majority of Taxi drivers' have No Record to worry about, but the ones that do always come up with an argument like this..... strange that isn't it...

The point being what is acceptable today may not be tomorrow. Injustice breeds injustice. You could be at the whim of these people like the rest of us, if we allow them to act in this way. You may find, as Martin Niemöller did, that when your turn comes to be treated unjustly there is nobody left to care.
A lesson we would all do well to remember.
