I mentioned this on the old taxiforums, and it's that I can't understand why it is going to appeal.

It must be that Scottish law is different to English law, cos down here a similar court case would involved two parties, usually a person or group of people against a council.

Whatever party wins the case, clearly the other has a right of appeal. But up there the losers have admitted they have no case to appeal. Then steps in the local drivers union, who decide to appeal against something that they weren't involved in, in the first place.

Those lads must have money to burn, and perhaps they should read the Wirral judgment.

But I bet they don't. :(

Yes, as I think has been pointed out in the past on the old forum, Dundee seems to ably demonstrate that disallowing plate transfers doesn't work, in fact in some ways it makes things worse!!

theres also the 40 applications lodged by individuals hoping to take advantage as 203020 did but who have had them delayed untill the survey number is released if its released in nov they should be heard in dec all will be refused but what hasppens when they go to court.

Yes Scot, it would have been useful to have included that in the story.

It seems that Dundee City Council delayed considering the additional license applications until the survey is available because it meant that the applicants could not challenge the decisions (presumably rejections) on the basis of no interim demand assessment.

So when the applications are considered, and presumably rejected, the council will have the results of the survey available and to that extent there would be no basis for a legal challenge.

However, I believe the survey was actually undertaken last year, so if the council haven't undertaken another interim survey when they actually decide the applications then who knows??

It's a pity that at the meeting last year the additional applications didn't go ahead, since they would then have been in a similar position to 203020, and could have mounted a legal challenge, but obviously once the loophole had been found the council tried to make sure that it could not be exploited further.

That is one of the biggest drawbacks in surveys, apart from they shouldn't happen in the first place. You have a survey, and over a year later the new plates it says need issuing, are still going through committee.

By then demand may well have grown, or for that matter declined. But the council will still base it's decisions on out-dated data.

The thing about Dundee is that the survey, I believe, was over a year ago, so really they are due another one shortly, or they will be back to square one.

Great idea the T&G have, in 'Managed Growth', eh !!!!! :?

Yes, I suspect that not only will the OFT not like license quotas in principle, but they will have a field day with these surveys.

halcrow are making a fortune out of these surveys, i wish i thought of starting a company that does surveys how hard can that be? come to think of it i wish i had anything apart from a taxi, sunbeds are doing well in dundee at the moment maybe ill try that
