I have a licensing issue with my local council. To summarise the council approved my vehicle for use as a hackney carriage prior to purchase. The vehicle passed the hackney compliance test and was issued a hackney licence. Complaints were recieved from other taxi drivers about the vehicle not meeting current specs and the council removed my plate, saying the licence was 'not yet valid', untill a panel meeting could be held to approve my vehicle for use as a hackney. I was told my vehicle could be used as a private hire vehicle in the interim period and was eventually issued with a private hire licence. I later had my hackney licence returned. The paperwork for the panel meeting contained many errors including revoking licence under section 38 of LG(MP) 1976, my licence was revoked on the grounds that it was issued in error without proper delegated authority but a new licence will be issued if a security screen and intercom are fitted. I have asked the coucil to meet the cost of these adatations but as yet have heard nothing. I have had no alternative but to lodge an appeal to the local magistrates. I think I have a solid case but can not get a local solicitor to take it on. can anyone help

Get as much written down as possible, who said what and when.

Get as much written info from the council as to why they refused something they had only just granted.

Ask them where in their rules it says you can't have what you presented as a taxi. Many councils have rules but don't have them written down, i.e. passed by committee.

Stick to your guns and insist that the only reason you bought that vehicle was because the council said it would meet their criteria. It should be the council that pays for any alterations, as you would not have bought that vehicle otherwise.

If you are going to a mags court then you should really have proper representation, and I'm surprised no-one wants your money. :?

Ah good old Mansfield Council.

As usual good solid advice from Sussex.

Its about the detail ............... and if they have made an error, and admitted that they made that error then I think you have a strong case which would be fairly heard if it got as far as Magistrates.

I'm sure that if you post more details you will get a great deal of help from the lads on here putting together a case.

Then when you approach a solicitor (with their research work done) they maybe more likely to take your case before the courts.

It will probably be easier to put the partion and intercom system and send them the bill

12b is to do with the width of vehicle dont know how your going to make it smaller
15d is communication
theres no mention of a partition
I think it should say i) That Hackney Carriage Licence Plate 61 be revoked on the grounds that within Section 60,1(c) of the Local Government Miscellaneous Provisions Act 1976, it was issued without proper delegated authority.They dont seem very competent :D

It would appear they gave a private hire licence to a hackney which is illegal,they got you to brake the law by issuing a private hire licence to your licensed hackney
