3.2 Driving Standards

In order to establish that an applicant’s driving experience is adequate, a licence will not be issued to any person who at the time of the application has not held a full driving licence for a continuous period of three years immediately prior to the date of receipt of a valid application by the Council.


The statutes say 12 months, so please ask your LO which laws says 36 months? :?

Having glanced at the conditions and apart from what Sussex has highlighted in respect of length of driving license then there isn't a lot wrong with the overall presentation.

The LO has put forward a strong position on quality control which we on TDO advocate. However if you take into consideration the whole package, then it is no different than what many other local authorities already have in place.

Our council has the same condition. I pointed out the best practice guidelines and was told that the 3 years was just a guideline and individual cases will be reviewed on merit.

You don't need to point out any guidelines, just statute law. Maybe you should ask your LO where it says he can ignore that. :?

PH driver's license criteria.

c/o sec 51 of the 1976 act

Licensing of drivers of private hire vehicles (1) Subject to the provisions of this Part of this Act, a district council shall, on the receipt of an application from any person for the grant to that person of a licence to drive private hire vehicles, grant to that person a driver's licence:
Provided that a district council shall not grant a licence—
(a) unless they are satisfied that the applicant is a fit and proper person to hold a driver's licence; or
[(b) to any person who has not for at least twelve months been authorised to drive a motor car, or is not at the date of the application for a driver's licence so authorised].


Ditto for HC driver's license criteria.

c/o sec 59 of the 1976 act

Qualifications for drivers of hackney carriages (1) Notwithstanding anything in the Act of 1847, a district council shall not grant a licence to drive a hackney carriage—
(a) unless they are satisfied that the applicant is a fit and proper person to hold a driver's licence; or
[(b) to any person who has not for at least twelve months been authorised to drive a motor car, or is not at the date of the application for a driver's licence so authorised].


Basically a 18 year old mush can apply for and get licensed as a taxi/PH driver anywhere in the country, as long as they have had a full driver's license for over a year.

Get your LO to speak to his union/association. And if he is not in one then suggest he joins one. :roll:

With this draft they have changed how often you need to have a medical.

Every 3 years seems like a big money drain on the drivers to me seeing that the doctors can charge anything they like.

How often do your councils ask you to have a medical????
