Fine in the long run,but how do I pay £700 PM Finance and rent another cab for £800 PM ?

Bex there are loads of rental places in London you could get one for about £60 a week, it does not have to be brand new does it, and you could reclaim all this when you go to court

You could also go PH for a short time and be the only driver who knows where your going

I think you are doing the right thing, but I suppose you have to be aware that the PCO could give you one of those of the road tickets if they agree with you it's unsafe.

Let's all hope this mess is cleared up soon.

Skip, in london you can`t even get an old fairway for less than £150 PW !

Just had VOSA on the PHONE ! Despite our T Hattersley saying my vehicle is fault free but still wanting to take it back to plant,VOSA will shut the case unless I let LTI investigate their self !

They have declined my offer to pay for an independant Engineers report !

Looks like LTI have the system nicely in their pocket,Just leaves my Court case now.

Further to our meeting of November 22nd and subsequent road test of your vehicle registration number LA56 GPK LTI Vehicles take the opportunity of thanking you for your time.
During our meeting you declined the request to allow LTI Vehicles to carry out investigations into your reported concerns other than allowing us to road test the vehicle and carry out a visual inspection.
You stated that you would not allow any dismantling of the vehicle or connection of any diagnostic equipment until after the case has been heard by the court.
LTI Vehicles have had no alternative but to advise VOSA of your position.
You are however requested that due to you stating to VOSA in your report that your vehicle "is an accident waiting to happen" that you reconsider your stance and give us the opportunity to either validate your reported concerns and take the necessary action or refute your concerns giving valid reasons.

Right bex get your solisitor to get a court order asking VOSA to inspect the cab asap

I would defo consider letting LTI have another look, with the proviso that you are there when they take it to bits.

I have a feeling the court may get the hump with you otherwise as they may well take the view that both parties to the court case could have resolved the issue beforehand.

But if your brief says otherwise, then listen to him.

I sincerely hope you are taking legal advice here. I think it should be your solicitor who replies to LTI and VOSA. Also, I am fairly sure you can hold the finance company accountable in the same way as paying for faulty goods on credit card.

Please consult your solicitor to see if you can stop paying the finance charges during this dispute. I am fairly confident he should be suing the finance company.

I wish you luck here, but you must use a qualified solicitor or you will be eaten alive.

I used a solicitor for a case, but wish I hadn't. He obviously didn't care as much as me, so didn't know the case as well as me. I had devoted so much time to it that I knew it inside out, same as Bexley I imagine. I wish I'd represented myself, although they do say 'if you represent yourself, you've got an idiot for a client.'

Bexley 129 - I am surprised it has not been made clear to you (or am I?) that you are wading into very expensive deep waters. If you were an ordinary punter buying a car you would have more rights within the law to call upon, simply because you would not be expected to know the ins and outs of the law.

Whether you like it or not, you are a businessman who has bought a tool for his business i.e. your TX4. The law expects more of you and makes it much more difficult for you to win your case in court.

By law if you purchase goods or a vehicle which you find to be faulty, you have to give the manufacturer the opportunity to rectify the faults. This you may have to do on more than one occasion. Only when the manufacturer refuses to rectify the faults will you find yourself in a position to sue and win, but you would need written evidence stating that they were not prepared to rectify the faults.

From what you have posted I would be very surprised if you won, as it seems to me you are playing right into their hands by refusing to allow them to repair your vehicle.............................. I would strongly advise you to speak with your local trading standards officer.

I can fully understand your frustration with LTI and hope that you resolve this to your satisfaction, but I would tread very carefully bearing in mind lawyers get paid whether you win or lose. Best of luck!!

As Mr T says it is and can be very expensive. You are to a degree going to have to play by the rules, it may look like their rules, but in actual fact it is the rules that the court would expect.

Whether you like it or not you are going to have to let them have the car to rectify the fault/faults, OR the chances are that you will lose the case on that alone.

Beware of the mates/guys who egg you on, you know, the type who say - we are behind you on this, because that is exactly where they are - behind you and not along side of you, the same type who put no money up, but you are the man.

I wish you all the luck in the world on beating these guys, but! they have been there before - you have not. The costs could become horrendous, think about what you are doing, have your independent report - and then give them the car.
