 Post subject: fare paid by 3rd party

hows this work

bloke comes along side cab window, tosses in 20 quid note, says take this lady home

lady in cab then asks how much did he give you, enough i said, lady asks for donated money so she can give it back to the person next day

right, whats the legal side of this
can i be done for taking the lady home [in this case meter fare was 6 quid] for overcharging, even tho the lady would not be paying

am i legaly requred to give the change to the lady in the cab?

stinky its your money, it happens all the time someone pays the fare for the punter so anything left is yours :D :D :D

Morally you should give the change if you knew that the passenger was totally honest, however two things come into the equation;

1) You could argue the person concerned has given you £20, with the instruction take her home. As such the fare/transaction was negotiated by the other party, so it was part fare and part tip.

2) How would you know that the other person was actually going to return the money, unless instructed otherwise you should retain the money for safe keeping.

Or am I wrong.

the lady did tell me she didn't know the bloke as he was from another part of the country but the same firm, up for a meeting, i asked was she having to go into work the next day [thinking about her giving the money back] oh no she said i got a week off now, after she told me she would hand the money back next day

so she made 14 quid out of that
i didn't sleep well at all, thinking back

If the person making the payment didn't specify what to do with any change, presumning there was any change, then one might assume the change is a tip. On the other hand if the gentleman had given you a five pound note instead of a twenty pound note would you have asked the girl for the balance on completion of journey and would she have been willing to pay?

An awkward scenario and one which I would ask your LO about but no doubt he will say give the passenger the change but whether his opinion would be correct in law is another matter?

I wouldn't have told her how much he paid. You have in fact been contracted by the third party to take her home. Unless he instructed you to hand her the change, she has no right to it. He could have asked for it himself if he wanted it, or given you instructions as to what to do with it.
You have been contracted to take her home, nothing more.

I go to our local bingo club on a Tuesday, night where you get 2 pints for a pound, carlsberg as well :D :D :D :D :D :D and its only £5.50 for a curry from the chinky
A double quarter with mixer for £1.20 :shock: :shock: :D :D :D

One senario that could cause a problem, if the said car was a Hack and the trip ended in the Hacks area, the journey would have to be metered, so if the fare was 6.60 and the guy definatly did not say keep the change, I would be concerned that the driver could leave himself open to being charged with overcharging?

the journey was in a Hack and in the Hacks area, in this case the journey metered £6.00 exactly

the bloke who tossed the 20 note into the cab melted into the crowd, after saying "this should cover it", i didn't make a contract with the bloke who melted into the crowd, he, out of the blue bunged me some money, or did i make a contract?? but a third party contract

for all anyone knows it could have been a bloke with too much money just giving it away to taxi drivers as he felt fit

the lady would have in theory been taken home so as to speak free of charge, so how could she state or report to anyone that she had been overcharged when non of her money was used or she didnt pay for it
