In our area the council will issue a special badge for a drivers Husband/Wife/Partner etc so that they can use a Taxi for personal use now and again as long as it is not used for hire or reward.

It may make sense, but the law is the law, and if they get pulled up by the police or flashed by one of those flashy things then driving without insurance is a minimum of 6 points and £200.

Just for my records what council are you licensed with? :wink:

So they issue a hackney carriage license and then put conditions on it? The only problem with that is the fact that they can't put conditions on a hackney carriage drivers license other than by way of bye-laws. I'm not saying it is not a good idea but I just wonder how it would play out in a court of law if the police decided to prosecute?

Which licensing authority does this?

Forest of Dean District Council, you have probably never heard of it. It is not a licence with conditions they issue just a card that looks nothing like a taxi badge that say the holder is authorised to drive the vehicle for personal use. Around here it is all owner drivers and they only have one car in the family so sometimes the wife needs it to go shopping i suppose. As for insurance, my policy says any licenced driver it does not actually not mention hackney licence.

I have heard of it actually and I think it is a great idea. They tell me they have issued about two of these licenses but as Gusmac says without looking up all the relevant case law I'm not sure how legal it is.

However if it is legal then there is no reason why it shouldn't be rolled out right across the country for both hackney and private hire.

A hackney driver's badge that can't be used for hire and reward?

Seems to me that if a council can do that legally then they could do just about anything.

Interesting isn't it? lol

The LO said they went into it in detail and they are satisfied it is legal. It would be an interesting case if it ever came to court but considering no one is likely to take them to court we shall never know. I suppose an insurance company would be the most likely to instigate court action but all the same its interesting.

I suppose that many of us agree that such a dispensation would be useful and equitable if provided for in law, but it seems to me that the LA in question are twisting the law to what they would like it to be rather than what it is.
