 Post subject: Lincoln PH Driver

This chap got 6pts (invalid insurance) and £300 for driving a PH vehicle whilst he had allowed his driver's badge to lapse.
Best of all, the fare he picked up was the LO who recognised him and knew he hadn't renewed his badge!!! :lol:

That could be one side of the coin, but maybe it's because the LOs are a bit more on the ball than most. :?

TAXI DRIVER CAUGHT BY LICENSING OFFICER


An unlicensed taxi driver was caught out after he gave a lift to one of the
city council's licensing officers.


Taxi driver Anthony Welburn 48 had neglected to renew his taxi licence
when he picked up the fare.

The passenger thought she recognised him, and when she got back to
work in August last year she checked the register of drivers and found his
licence was three months out of date.

Welburn, of Coleridge Gardens, St Giles, Lincoln, admitted driving without
a licence and driving without insurance, which was invalidated by the lack
of taxi licence.

Leo Pyle, in mitigation, said that Welburn, who now works as a machine
operator, had been driving for Handsome Cabs since 2006 and had
forgotten to renew his licence after his marriage collapsed and his house
was burgled.

Lincoln magistrates fined Welburn £300 and gave him six penalty points on
his driving licence. He was also ordered to pay a £15 surcharge.

Licensing in Lincoln always sends a reminder around 30 days before your drivers license, vehicle license and test are due.

Really? That has not been the case since Richard Crossley retired in 2005.

The driver badges do have an expiry date in 26pt. however, and should be a clue.

Wonder why Handsome (sic) Cabs were not prosecuted for using an unlicensed driver?

(d) no person shall in a controlled district operate any vehicle as a private hire vehicle without having a current licence under section 55 of this Act;

(e) no person licensed under the said section 55 shall in a controlled district operate any vehicle as a private hire vehicle—

(i) if for the vehicle a current licence under the said section 48 is not in force; or

(ii) "if the driver does not have a current licence under the said section 51".

(2) If any person knowingly contravenes the provisions of this section, he shall be guilty of an offence.

If he forgot to renew his badge, I doubt that he remembered to inform his firm :lol: .

It seems like this driver has a poor memory. but memory loss might have been a convenient excuse when the license fell due for renewal but after that initial period he was confronted with his badge details every day he put it on to go to work. Only he knows why he didn't renew it after the expiry date but it certainly wasn't through any long term memory loss.

Perhaps Lincoln council should introduce an operators condition of license that insists they keep badge and insurance details of all drivers and vehicles they operate.

If the operator had been prosecuted I doubt he would have been able to rely on the defence that he failed to make sufficient enquiries or keep sufficient records of the drivers he operated.

Really? I've always received reminders regarding licensing since 2005, therefore I renew them a couple of weeks in advance to save any hiccups.

We get reminders for vehicle tests 6 weeks before due date but they are a bit slower on badge renewals only 4 weeks which is a problem because with 7 to 10 days wait for a medical and you cant hand your forms in until you pass your medical then 6 to 8 weeks wait for the CRB check it is quite normal round here for badges to run out long before new ones are issued but on a renewal that is deemed to be OK as long as the forms have gone in before the renewal date. If you forget your application is treated as if you are a new applicant and you cannot drive untill you get your badge

I've set summats off here!
As far as I know, the Council is not obliged to remind anyone of any renewal. Also, if people do leave it too late to get the correct docs in, CRB, Medicals etc, then tough - although on renewal, I know some Councils will issue the badge with the caveat that if the CRB comes back with owt on it, then the badge issued is voided.
