It will be a couple of weeks before they give their ruling and it will be on the scottish courts website.

JD

So they do not make the decision tomorrow and we have to wait that bit longer

In this particular case yes.

JD

These issues need to be studied and digested by the judges, the trade needs a clear-cut judgement, not the usual faffing about.

I heard the lady concerned (with this judgement) on the radio today, and although it has diddly squat to do with the Sneddon case, it should give hope to all out there when taking on the big (bad) guys.

http://www.bailii.org/ew/cases/EWCA/Civ/2009/46.html

And I've voted Lord Justice Jacob judge of the year 2009 just for his first paragraph. =D> =D> =D> =D>

This case must have been pulled out of the list for this week because I can't see it listed. I'll get an update tomorrow.

XA173/07 Appeal in the Summary Application under the

Civic Government (Scotland) Act 1982, Section 4 - in the cause -

Thomas Sneddon against Renfrewshire Council

Still on course so it would appear.

If it goes MR Sneddons way, does that mean owners all over Scotland will have the freedom of choice of vehicles and that councils cannot impose an all WaV condition

Hopefully yes, that will only leave the Liverpool case to sort out the rest of the UK's WAV problem

Yes, if Renfrewshire's appeal is denied, that will be the situation until such time as the Scottish Exec. step in with regulations on the WAV issue.
Any victory could still be short lived.

English law is different on this since councils do have the power to impose such conditions. Whether a court will deem them reasonable is another matter.
