Hi Mr SP,

I see your point of view, but as JD informed us, I believe at the end of the day it would be down to how your L/O saw the situation.

I would like to give an example of how one of our Hack lads got into trouble in a similar way.

Wheelchair user asked Hack driver to do a regular run twice a week, going from an address in Brighton to another address in Brighton. Usual metered fare £10.00.
Driver informed customer he would be willing, but as he would have to make arrangments and miss out on other work, he would charge £20 for each trip.

Customer agreed, family member found out about this, informed L/O, driver very lucky to keep licence.

I would say driver morally was in the right, legally, according to our L/O in the wrong.

As in your case, what can seem morally ok to us drivers, can be seen in a very different light by our L/O's.

So your backing him for riping the public off, :evil: :evil: your LA was quit correct in bringing him to book, :D :D he was breaking the law period, by not having the meter on , and over charging, is it any wonder punters give all of us a hard time over prices, if we could get rid of the chance rs in this game we would have an easier life. 8) 8)
Stinky's situation is totally different as they guy did not ask how much,, or give any other instructions as to what to do with the change, so in law the change would be his, as it was the guy who approached him who made the contract, and not the punter in the cab

it also could be said you are overcharging if you issue a receipt over and above the meter fare


you take the punter wherever he wants, he then says how much, lets say its a fiver, he says oh make that 8 quid and give me a receipt

next day there is nothing to stop him going down the LO and saying, i got ripped off last night and taken advantage of, here i have a reciept to prove it

thats why i always sign the receipt "Mick Mouse"

The Inland Revenue lost out on that 20 quid, i would have paid income tax on that, but it went buckshee into someones pocket

If you had said £20 for a £6 within your area fare, then you would be breaking the law.

But the punter said £20.

So as long as you put your meter on, I think the rest is a big fat thank you tip for getting the lady home safely. :wink:

I would agree. As the arrangement was between you and the bloke, only he can dispute it. :wink:

Some of the driver here would have said is twenty pounds the most you can offer.
And there would be no chance of any change.

That actually happened to me once, I pulled up on the rank, busy Saturday night, bloke staggers up to my window, hands me £10 then staggers away. I have no idea who he was.

IMHO, the driver is liable to the bloke for the money. His answer to the girl should be that he will hold the money to return to the originator next time he sees him. Giving the change to the girl could conceivably make him a party to theft.
