I would say driver morally was in the right, legally, according to our L/O in the wrong.
As in your case, what can seem morally ok to us drivers, can be seen in a very different light by our L/O's.

your LA was quit correct in bringing him to book,

he was breaking the law period, by not having the meter on , and over charging, is it any wonder punters give all of us a hard time over prices, if we could get rid of the chance rs in this game we would have an easier life.
Stinky's situation is totally different as they guy did not ask how much,, or give any other instructions as to what to do with the change, so in law the change would be his, as it was the guy who approached him who made the contract, and not the punter in the cab
